This Privacy Policy describes how Productiv Staff LLC, an Illinois limited liability company (“Productiv Staff,” “we,” “us,” or “our”), collects, uses, discloses, and safeguards personal information through the TruckersData platform, including our websites, web applications, embeddable forms, APIs, referral links/QR codes, and related tools (“Services”).
This Policy applies to:
Applicants (drivers or individuals applying to companies)
Registered Users (Applicants who create accounts)
Companies (motor carriers, fleet owners, recruiters, and their personnel)
TruckersData Admins/Users (Productiv Staff employees and support personnel)
Visitors to our websites
This Policy applies to users in the United States.
For most Applicant information, Productiv Staff acts solely as a service provider / processor on behalf of the Company to which the Applicant applies. The Company decides:
What information to collect
What disclosures and consents are required
What background checks or screenings to run
How long data must be retained
Which personnel or third parties can access Applicant information
Productiv Staff processes data strictly according to the Company’s instructions. We do not provide legal compliance guidance and are not responsible for Company compliance with federal, state, or local laws.
We act as an independent controller only for:
Platform accounts
Authentication
Subscription/billing
Usage analytics
Security and fraud monitoring
Communications sent to Productiv Staff
Companies configure the forms Applicants complete. Information may include:
Full name
Address
Phone
Date of Birth (DOB)
Social Security Number (SSN)
Driver’s license number and issuing state
Employment history (at least the past 3 years, and up to 10 years for CMV history)
Driving experience, violations, accidents
FMCSA Clearinghouse data
MVR reports
Drug/alcohol history reports when authorized
Criminal background screening data
Previous employer verifications
Credit checks (if used by the Company with lawful consent)
Electronic signatures
Timestamps and IP addresses
SMS consent
Company-required legal notices and disclosures
IP address
Device, browser, and session data
Referral links, QR codes, query parameters
Processed only under Company direction, including SSN, DOB, MVR, drug/alcohol history, criminal history, and Clearinghouse results.

Only Companies and their authorized Company Admins/Users may access SSN and DOB for legally required screening and compliance activities.
We use the data collected to operate the TruckersData platform and facilitate the hiring process. Specifically, we use personal information to:
Provide our core Services and facilitate communication between Applicants and Companies.
Generate PDFs, forms, consents, and Driver Qualification (DQ) file documentation.
Allow Companies to perform legally required FMCSA/DOT compliance checks, background screenings, and employment verifications.
Authenticate users, improve the platform, and ensure security.
To make the hiring process easier and more efficient for Applicants (truck drivers), our system tracks your application progress from “started” to “submitted.” We securely store this data so you do not lose your work.
Resuming Applications: If you leave an application before finishing, you can easily resume it. Our system securely matches your primary identifiers (Email Address, Name, Date of Birth, and Social Security Number) to locate your incomplete application and let you pick up exactly where you left off.
Future Applications: When you submit an application, your data is securely stored in your TruckersData profile. If you choose to apply to a different Company using our platform in the future, our system will use this matching logic to locate your stored profile and auto-populate your new application. Your stored data is never shared with a new Company until you explicitly review, authorize, and submit the new application to them.
Applicant Responsibility for Accuracy: While our system auto-populates your stored data for your convenience, you are solely responsible for reviewing and verifying that all information is accurate, complete, and up-to-date prior to submitting any application. Productiv Staff LLC is not liable for any adverse employment decisions, rejected applications, or compliance issues resulting from inaccurate or outdated information submitted by you.
Incomplete Applications: We reserve the right to securely delete unsubmitted, abandoned applications after a period of inactivity, at our sole discretion.
When an Applicant applies, all application data is shared with that specific Company and its authorized users.
For hosting, storage, analytics, communication delivery, and operational support.
Only when a Company configures API/webhook/CRM integrations.
When required to comply with laws, subpoenas, or court orders.
When you explicitly authorize sharing.
Productiv Staff does not sell personal information or share it for cross-context behavioral advertising.
Notwithstanding any other provision of this Privacy Policy, mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties, other than our direct service providers (such as SMS routing providers) strictly for the purpose of sending the messages you have consented to receive.
Company Messaging Responsibilities: When you provide your phone number, you consent to receive application process and status updates from the specific Company (carrier, fleet owner, or recruiter) to which you are applying. These Companies will contact you using dedicated phone numbers. Productiv Staff LLC acts strictly as the technology platform facilitating these communications. The Companies are solely responsible for complying with all applicable messaging laws, including the Telephone Consumer Protection Act (TCPA), state-specific texting regulations, quiet hour restrictions, and promptly honoring all opt-out/unsubscribe requests (such as replying “STOP”).
Companies, not Productiv Staff, are solely responsible for:
Legal compliance with FMCSA, DOT, FCRA, TCPA, CAN-SPAM, and all state/federal employment and privacy laws
Obtaining lawful consents
Background checks, Clearinghouse queries, MVR requests, drug/alcohol testing history checks
Maintaining legally required 3-year employment/driving history
Safeguarding SSN, DOB, MVR, background checks, drug/alcohol history, and all sensitive information
Retaining or deleting Applicant data according to law
Protecting data exported to their own systems (CRM, ATS, email, internal databases)
Productiv Staff is not responsible for a Company’s compliance failures or unauthorized disclosures outside the platform.
The TruckersData platform provides tools to facilitate past employment verifications via email. Productiv Staff LLC acts strictly as a data processor transmitting these requests. We do not independently verify, warrant, or guarantee the accuracy, completeness, or authenticity of the contact information provided by Applicants, nor do we guarantee the identity or authority of the individual responding on behalf of a past employer. Companies (carriers and recruiters) are solely responsible for ensuring they have the correct contact information, verifying the authenticity of the responses received, and fulfilling all regulatory requirements under FMCSA, DOT, or other applicable laws.
Productiv Staff retains data:
As needed to operate the platform
As required by law
As directed by Companies
For backups, audits, and security
Deleting your TruckersData account:
Revokes future consent within the platform
Removes your ability to auto-fill future applications
Notifies Companies that your Registered User account has been deleted
Does not delete data already retained, downloaded, or required for a Company’s compliance purposes
Applicant rights depend on the state where you reside. Where applicable, you may request:
Access to your personal information
Correction of inaccurate information
Deletion of your data
Portability of your information
Restriction of certain processing activities
If you are a California resident, the California Consumer Privacy Act (CCPA) grants you specific rights regarding your personal information, including the right to know, delete, and opt-out of the sale of your data. As stated in this policy, Productiv Staff LLC acts primarily as a Service Provider.
To exercise your privacy rights regarding data held by a Company, you must contact that Company directly. To exercise rights regarding your TruckersData platform account, please contact us at legal@productivstaff.com. Productiv Staff LLC does not sell your personal information.
With every application, Applicants have the option to create a Registered User account.
As a Registered User, you may at any time:
View all Companies you have applied to
View timestamps and IP addresses associated with applications
Withdraw your applications
Request deletion of your account and data within the TruckersData platform
Manage SMS and communication preferences
When you delete your account:
Your applications will no longer auto-populate
Your ability to access past applications may be removed
Any data already processed and stored by Companies (including DQ files, compliance documents, screenings, and background checks) will remain with those Companies
Applicants must contact Companies directly to request deletion or limitation of data held by those Companies

If your information is processed on behalf of a Company, we may instruct you to contact that Company, as they determine:
What data must be retained
What screenings they have performed
Whether data can be deleted under FMCSA/DOT/FCRA or other legal requirements
We implement reasonable safeguards, including encryption, access controls, audit logs, and secure hosting practices.
No system is perfectly secure. Users must protect their login credentials.
The Services are not intended for individuals under 18.
We do not knowingly collect information from children under 13.
The Services are intended for U.S. use.
Personal data is stored and processed in the United States.
Third-party platforms (CRMs, ATS systems, background check providers, etc.) operate under their own privacy policies.
We are not responsible for their practices.
